These Terms and Conditions ("Terms") govern your use of the Y.U. website and your relationship with YU Health LLC ("Y.U.," "we," "us") as a visitor or prospective client. If you become a paying client, your services are additionally governed by the Client Services Agreement and Informed Consent and your Membership Agreement, which control over these Terms for any conflict regarding the delivery of services.
1. Acceptance of Terms
By accessing or using the Y.U. website, you agree to these Terms. If you do not agree, do not use the site.
2. Eligibility
- You must be at least 18 years old to create an account or purchase services.
- Clinical Services can only be lawfully delivered to you while you are physically located in a state where Y.U.'s Clinical Provider is licensed.
3. Description of Services
Y.U. offers Coaching Services (health coaching, nutrition coaching, fitness and body mechanics coaching) directly, and coordinates access to Clinical Services delivered by independently licensed Clinical Providers. A full description of the distinction between these service types is set out in our Client Services Agreement and Informed Consent, provided before any paid engagement.
4. Medical and Educational Content Disclaimer
- Content on this website, including blog posts, social media content, and marketing materials, is for general educational purposes only and is not individualized medical advice.
- Nothing on this website creates a provider-client relationship. A provider-client relationship begins only after you complete intake and execute a Client Services Agreement.
- This website is not monitored for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
- Y.U. does not guarantee any specific health outcome, weight change, laboratory result, or performance metric. Individual results vary.
5. Membership and Payment
Pricing, billing cadence, and cancellation terms for paid memberships are set out in your Membership Agreement and Fee Schedule, provided at enrollment and incorporated into these Terms by reference. View current membership tiers and pricing.
6. Intellectual Property
The Y.U. name, the "Y.U." mark, "Your Origin, Unleashed.," "Fuel. Grit. Will.," and all related logos, graphics, and content on this website are the property of Y.U. and its licensors and may not be copied, reproduced, or used without prior written permission.
7. User Conduct
- You agree not to use the website for any unlawful purpose or in a way that could damage, disable, or impair the site.
- You agree not to attempt to gain unauthorized access to any account, system, or network connected to the website.
- You agree to provide accurate information when creating an account or submitting intake forms.
8. Third-Party Links and Services
The website may link to or integrate third-party services (for example, our EMR platform, supplement dispensary, payment processor, or wearable device integrations). Y.U. is not responsible for the content, accuracy, or practices of third-party services, which are governed by their own terms and privacy policies.
9. Limitation of Liability
To the fullest extent permitted by law, Y.U. and its officers, employees, and contractors are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the website. This limitation does not apply to claims arising from the professional negligence of a licensed Clinical Provider in the delivery of Clinical Services, which are governed by the Client Services Agreement and applicable Florida law.
10. Indemnification
You agree to indemnify and hold Y.U. harmless from claims arising out of your misuse of the website or breach of these Terms, except to the extent caused by Y.U.'s own negligence or misconduct.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the website after an update constitutes acceptance of the revised Terms. We will post the updated version with a new "Last updated" date.
13. Termination
We may suspend or terminate your access to the website at our discretion, including for violation of these Terms. Termination of website access does not by itself terminate an active client services relationship, which is governed separately by your Client Services Agreement and Membership Agreement.
